Abstract

The aim of this article is to provide an analysis of the current regime on foreign private investment in Ecuador, based on the relevant provisions incorporated in the organic code of Production, Trade and Investment (December 2010), and then comparing this provisions with the principles established in the Ecuadorian constitution that govern the economic system and related areas. In addition, the assessment will compare the effect of recent legislation with the criteria of consistency contained in the guidelines of government planning and several principles contained on the international system of investment. Finally, the present work will provide remarks about future regulatory adjustments that shall be considered in this field.
