Abstract

This paper analyzes the treatment that the 2008 Constitution gives to the equality focused on gender, and to that end, it delves into the principles shaping this Constitution and into the mechanisms that allow its effective implementation. That is the reason why we find in this article a theoretical approach of gender equality, its integrating principles, and its development in the 2008 Constitution. Finally, this paper addresses the issue of the mechanisms foreseen in the Constitution for the effective implementation of gender equality from a legal framework, which when compared to reality, shows the ineffectiveness of various constitutional provisions, resulting in deficiencies in the implementation of gender equality on a practical level.
