State Responsibility for the Ineffectiveness of the Andean Integration Proces

Abstract

Although trade within the Andean Community has grown significantly, integration remains in an imperfect stage of customs union. True subregional solidarity is lacking, as each state maintains its own foreign policy stance. This statist approach clashes with the integrationist one. The lack of political will also contributes to the Community's ineffectiveness, which in turn makes member states responsible for protecting the rights of individuals whose rights have been violated, as they are the primary beneficiaries of the integration project. Therefore, a right to redress for damages caused by non-compliance with community provisions can be derived.
