Abstract

This paper aims to determine whether the Andean Community's current legal framework regulates the concept of a well-known trademark. To this end, it will define the current distinction between a famous trademark and a renowned trademark, and then, in a very general and basic way, demonstrate the protection afforded to renowned trademarks under Spanish, European Union, and North American law. Finally, based on the protection afforded to well-known trademarks under the current Andean intellectual property regime, it will conclude whether it is necessary to distinguish between the two types of trademarks and, consequently, whether renowned trademarks receive special protection.
