Abstract

The author argues that Congressional Resolution No. 25-181, dated December 8, 2004, which dismissed the justices serving on the Supreme Court of Justice until that date, is unconstitutional. To support his argument, he reconstructs the facts and the law from 1997 to 2004, analyzes Resolution No. 25181 in detail, and challenges its weak legal and factual foundations. Furthermore, he employs specific methods and principles of constitutional interpretation. In addition to the constitutional violation, the author also examines the infringement of the individual rights of the Supreme Court justices dismissed from their posts in December 2004.
