Abstract
This article confronts the minimum criminal law theory with some examples of criminality in the proposed Organic Penal Code, as a posibility to warn of a criminal expansion, in which various social conflicts and events seek to be resolved via deprivation of f liberty as the only mechanism. It seeks to reflect on the need to expand the discussion of criminal law before its entry into force or, at least, alert to the possible need for demanding the constitutionality of various crimes and contraventions that could be adopted in the coming months.
