Abstract

This essay discusses the need to maintain the primary criminalization of serious crimes committed by the State or with its acquiescence, in order to guarantee the rights to truth, justice and reparation for victims and families of the victims, and the right of society that these events are not repeated again. Thus, the primary criminalization should be analyzed in the context of human rights and the need to redress the violations committed by the State.
