Abstract

In this paper I develop a case study of paradigmatic character, the first in which the Inter-American Court of Human Rights examines sexual orientation with relation to the exercise of human rights. I address the following question: to what extent does legal discourse in the case of Karen Atala reinforce and/or question heteronormativity of the traditional concept of family? To provide an answer, I analyze the ruling of the Supreme Court of Chile, the lawsuit filed by the Inter-American Commission on Human Rights (IACHR) in the Inter-American Court, the ruling of the Inter-American Court, and various Amicus Curiae filed in the IACHR and the Inter-American Court by members of non-governmental organizations (NGOs) and academic institutions.
